Understanding responsibility
A recurring leak, earlier complaint, or cleaning record can help explain how a condition developed and what was known. An incident report records a report; it does not by itself prove responsibility.
Information worth preserving
Keep photographs of the exact area, signs, surrounding aisles, lighting, and the shoes you were wearing. Note who received your report and when.
Ask about preservation early
Surveillance and other records may not be kept indefinitely. Tell the firm what happened, where it happened, and what records may exist. You do not need a complete file before asking about your options.
The applicable duty, notice requirements, and defenses depend on the facts and state law.
